Man shops at Utah JCPenney while carrying assault rifle

A man in Riverdale, Utah walked into a local JCPenney department store this week armed to the teeth, carrying a holstered handgun, a semi-automatic assault rifle and extra clips on his belt.

The strange display of firepower was enough to draw a scene, with bystanders taking photos and making concerned comments to one another. Images of the man published to Facebook caused a stir in the community and got the attention of ABC 4 in Salt Lake City.

The woman who took the photo that got the most attention said it happened on Wednesday, just four hours after President Barack Obama announced a series of executive orders relating to firearms.

Utah state law, however, says the manís actions are legal, provided the weapons were unloaded. The man was not positively identified, and JCPenneyís public relations team did not respond to a request for comment.

1. Attention seekers...setting up confusion

They get to make their statement and enjoy being at the center of a kerfluffle standing on a 2A molehill

But they also divert attention of security.

They care much less for society than they do for their desire to be the center of attention.

probably ends up generating more gun sales with people who are uncomfortable/nervous with these displays of private firepower.

reasons.

Lot's of people seek their narcissistic supply in marginally acceptable ways.

187. Just another political activist to me

He's just being an activist for the cause he believes in. I fail to see a problem.

I mean his actions aren't even up to the level of civil disobedience, as he is breaking no law.

One person's activist is another persons arsehole, moron, whatever the insult of the day is.

197. Why Should Your "Activist" Be Trusted, Given The Mass Killings Of Recent Months?

A guy strolling into a store with an assault rifle plainly visible, and people are supposed to just accept it as something normal? As if the incidents in Newtown, CT and Aurora, CO (and dozens of other occurrences before them) never happened? Just because it's somehow legal, sure as hell doesn't make it right.

Think somewhere someone finally banned public nudity.. in CA. zzzz oh but one can carry a full to the rack up his ass gun collection...

Personally I'd rather see like no dress code at the mall. that someone trying to give a few of us heart attacks. oh well the nudity might cause blindness but whoops.

Sorry, but anyone who feels compelled to carry these weapons in public, is already a strange dude. At the very least, someone with paranoid and anti-social tendencies. What a joke - OK because the weapon was unloaded....like he couldn't snap the magazine in the rifle and start another massacre in seconds.

not long ago.

It had the desired effect of getting her attention. Calls among leaders of local congregations revealed she's been trolling houses of worship.

then they be the "Ye, of little faith" type. I mean, if one really believes in God, then bringing a gun is saying you don't trust in God.

It's not really possible to be inside her head, but she visited a variety of non-denominational other than funadamentalist assemblies in the area.

People have all manner of emotional needs that don't necessarily interfere with their daily function, to me she seemed to be enjoying the attention avalanches she tripped by skiing along a steep slope whose downside is trouble.

154. I know nothing about these weapons but

do they also have the "one left in the chamber" type problem that some handguns have when you take the clip out, but one bullet has already been locked in? People sometimes take the clip out and think it is now unloaded without realizing that one bullet is still in there ready to fire.

Do these things have that kind of possible oops shooting?

193. Sure.

Most semi-auto weapons would have that issue.

Full auto maybe not. Some fire from a position called an 'open bolt', in which case the chamber would be empty.

This is the reason for firearm handling rule #1: All firearms are always loaded, period.

I have friends that are no longer allowed to handle firearms in my home, or in my presence at the range or gravel pit, due to violations of this rule.

If these guns can have a bullet in the chamber, then they absolutely can not have it in there. I mean logically, not legally, yet.

Too many idiot gun owners. Hell they accident ly shoot themselves this way. Why should be be subjected to it?

Did you see the video of idiot gun owners and their guns going off accidentally in just this way plus other stupid moves by the owners? It's really kind of funny. I have a link to it further down in one of my post. It is a must see video.

just posted the same thought. yes, it there does appear to be one. of course it still may be legal to have an unloaded magazine in the weapon and it be considered unloaded. although the simplest way to assure that it isn't loaded w/more than one potential round in the chamber is to prohibit the insertion of the magazine, or hey, here is an idea, don't let people walk around the mall with loaded guns strapped all over them regardless.

People who bark about 2nd Amendment rights relating are the lunatic fringe--even for the average gun owner. I don't think most people see hand guns and assault rifles in the same light.

Go ahead--put those assault rifles in everyone's face. You don't represent us. You don't represent the Constitution.

The backlash is already on the way.

70. That is exactly it. Where does he thing he is? Iraq, after we were done with it?

The very act of being in public that heavily armed, is, or at least should be, an act of terrorism. It scares the populace unnecessarily. How is that not terrorism? It also has to be bad for business.
If he is that paranoid, that he thinks he needs his guns in public, that alone proves he should not be allowed to possess them.
How is anyone supposed to know that he doesn't have one in the chamber? Is he even sure, one way or the other?
Pity that guy if another armed someone, still shell shocked from another mass shooting shows up. Another public massacre waiting to happen.

an amatuer to me. Weapon slung behind him and out of his immediate control. If loaded, someone could come up behind him, grab it and pull the trigger killing bystanders. This idiot is totally vulnerable to some nutcase who could walk up behind him in line and simply pull out a concealed weapon and pop a few rounds into this guy's head or torso despite the fact he is armed to the teeth. Stringing yourself with weapons like a Christmas tree isn't necessarily going to protect you if some nut is determined to get you.

And if they don't make it a gun free zone, I think they could, on case by case basis, tell the moron he is disturbing paying-customers and he needs to leave the store. A store is private property, state law to open-carry not withstanding (I believe a property lessee/owner could do this in stores here in the South, and I'd think they could even in wild west Utah). If he doesn't leave, then the store's management could call the law re; man refuses to leave store when asked/trespassing complaint.

Because that worked so well.

I don't think this guy needs an ar15 and what he is doing is stupid. But I don't support making every place a gun free zone, because the moment you do, then the nut jobs know where to go to kill the most people possible before they meet any resistance at all.

I think that you should be able to bring a reasonable self defense weapon with you most places, but such a display as this is not reasonable and only hurts the ideals of how a responsible gun owner should exorcize their right to bear arms.

note to jury:

Yes, I am a new poster, but I have lurked for many years, and I wish to join the discussion here on DU. Most of my views are progressive, except when it comes to fire arms. I don't ascribe to NRA talking points, but I don't support taking fire arms away from law abiding citizens either. The crooks will get them legal or not. Law abiding citizens should be able to get them as well, provided they pass a background check. I'm all for a "well regulated militia" in that I think that at the very least, all states should be "shall issue CCW" provided the license holder passes a background check, and possibly a psyc evaluation.

If I can't shop there without my shirt, he should not be allowed to shop there with that thing. I can't imagine any stores that would actually want this guy in there. Accidents happen and they would probably be sued. And so what is to stop the robber from just strolling in with his gun?

96. I actually did just about that once

I was at our local Office Max here in semi-rural Arizona a couple of months ago and saw that the idiot in front of me in line was carrying a gun. I turned to my husband and said in a normal tone of voice, "Did you know that men who carry guns have been shown to have small dicks?" The cashier looked up, startled; my poor husband cringed a bit (although he knows I'm a bit outspoken sometimes, so he wasn't too surprised); but the best response was from the guy with the gun. He sort of shrank into himself, stuttered a bit when he finished with the cashier, and quickly left. It was obvious that he had heard me and equally obvious that he was embarrassed.

I like to think that maybe he thought twice before strapping on that gun the next time he went to a store.

OK maybe it is unloaded, but does he carry ammo with him? If so, how long does it take to lock and load? So, he's carrying immense "potential" fire power.

So he's legal until he loads. But it only takes seconds to go from legal unloaded to illegal loaded and deadly lethal.

If he doesn't carry ammo, then what is the point of having the gun?

Ergo, he must be carrying ammo. Which means he is only a few seconds away from being deadly lethal.

Do we need to have cops following these people around every where they go, waiting for them to load?

WTF?

You dont see people waking around with AK47's walking around. THere was one guy in town who had a bunch of guns strapped to him, and when he blew his brains out everyone said they were wondering when it would happen not IF.

It is not normal to terrorize people in public places no matter where you are. ANd you can be smug and put it on the people who dont have guns all you want but most people in the wake of all of the shootings will justifyably be fearful if they see some jerk walk in with an AK 47 strapped on. Anyone who does that is knowingly terrorizing people and is doing it TO terrorize people. And in NH if you saw someone go in to a store with an AK47 strapped on and called 911 the police WOULD come and it wouldnt be "shame on the people for being frighted" it would be "why are you being such an asshole" get out now.

On Thursday, 22-year-old Joseph Kelley identified himself as the man in Yorgasonís pictures. Kelley described himself as a firm believer in Second Amendment rights and said he decided to bring the guns to the store to demonstrate that they are not dangerous in the hands of law-abiding citizens.

According to Kelley, the rifle was an unloaded AR-15 and the handgun was a loaded Glock 19C. He said he has a concealed-carry permit, is a former member of the military and contacted police dispatch before leaving his home to tell them about his plans. Kelley also said he was told that he was "well within his rights" and that bystandersí reactions were positive.

"I felt no negative vibes from anyone," Kelley said. "I think it went rather surprisingly well."

Kelley added that he carries weapons to protect children and other people from "criminals, cartels, drug lords" and other "evil men."

68. So why hasn't he been arrested? The first story said the guns had to be unloaded. He

says the Glock was loaded. Is Utah one of the idiot states that makes it illegal for a private person, church, or store to prevent the gun crazies from carrying on their property? We have a state representative that is bound and determined to let anybody on my campus carry a loaded gun. When that passes, I retire.

But where is his badge?

"Jason Chapman, the firearms supervisor for the Utah Department of Public Safety, said a person with a concealed-carry permit may carry a loaded gun publicly. Permit holders are not required to conceal their guns. People without permits are only allowed to carry unloaded weapons in public, Chapman said."

My point wasn't that I wanted him to become a cop; my point was that anyone with altruistic feelings to protect children and other living things (with weapons involved) does so in a societally appropriate way by joining the police force....the old "to protect and serve" paradigm. One doesn't flounce around JC Penny wearing a large weapon like a fashion accessory and convince anyone of anything save "That clown with the gun has ISSUES." It would seem, they said, that he may be lying about military service or has been discharged early for some reason.

If the site had not been touched in 3 years and 3 years ago he had not yet joined, then if this is actually his site, he is lying or was kicked out. Even the military doesn't want gun nuts.

Seriously? I just don't get your country. That would simply never happen up here (in Canada) Here there would have been about 10 police cars, and a swat team to greet him when he arrived at the mall.

I'd be terrified, especially if I had kids with me. It IS terrorism. I'd be scared to death if I lived in that district. If this "normal" guy can go out buried in weapons like this, so can a deranged Beck-warped individual who also looks normal and the police would just yawn as he walked by. Yikes.

and people start getting used to seeing it, how long before people get "comfortable" with it and ignoring an actual mass murderer until it is too late? What if it starts encouraging more and more people to do the same- in order to feel "safe" with a bunch of other people wandering around with guns and assault rifles? This could have some messy consequences but, hey, we're human and sometimes I guess it takes multiple needless tragedies before we get our heads screwed on right?

106. I'm sure that it is

The problem is that I think that people SHOULD be *afraid* of guns and and even anybody whom owns one should "respect" them enough to recognize the need to be responsible with them as they have the power to snuff out life. In some sense, you could say that when you are carrying around a gun (or any weapon for that matter) you are literally carrying around with you the power of life and death. I don't think that people should be "desensitized" to seeing people anywhere and everywhere toting around guns, assault rifles, etc. I don't view everybody whom owns guns as potential criminals but seeing people openly carry weapons around anywhere and everywhere will make it harder to know when and where there might be an actual potential dangerous person. Just something to think about.............

168. So the next mass murderer just has to call the police first??

This guy told the police he was taking an assault rifle into a mall and no one did anything. Does that then set a precedent? So, the next mass murderer can call the police and say he is taking three unloaded assault rifles, a couple of shotguns and a couple of handguns into a mall and they won't do anything until he has loaded them (a couple of seconds) and opened fire. THEN the police will get to deal with another nut, armed to the teeth, in a mall, and killing innocent people. The NRA will Immediately begin a campaign for more guns in malls, to stop the shooter, they supported, up until he pulled the trigger. It goes on and on with these people. The true gun nut is a racist asshole, hoping to die a hero, while defending friends, family, or self from the Dark Hordes that exist in his imagination. Insanely racist and armed. What could go wrong?

171. Do men even realize what a turn off guns are to women?

I will never, ever date a gun owner.

173. What about our 4th Amendment rights?

Thousands upon thousands of times every day our 4th amendment right is violated at airports by government agents. Where is the public outcry for this violation?

179. My first two thoughts

1. Well we now know who has the smallest pecker in Utah.

2. Good thing this guy was not in Florida or someone could have shot him first and totally justified it under the stand your ground law. If Skittles and a drink get you shot, what does openly carrying weapons get you?

184. How are people supposed to know

who is crazy and who is just exercising their rights?

say you dismiss someone with a gun as the later,
only to find out moments later.. ope.. it was the first

thats my problem with open carry :p

it would have been hard for me not to have been like *cough pussy cough*

188. If this is tolerated...

the next shooter can stroll in with his weapon and casually wait for the best moment for the highest body count, or a small number of terrorists could easily take their places and coordinate something horrible.

This is insane.

191. I concur with all of the replies here stating, in short, "What an asshole!"

And, generally, what part of "Well regulated militia" don't people understand?

198. Here's how to troll the assault rifle threads...

If he needs that, then he obviously can't shoot worth a damn. This gun needs shooting lessons more than he needs an assault rifle. I could probably do more damage with a Red Ryder BB gun than these assault weapons "can't aim" wimps could to with their whole arsenal. Me: one bullet, one shot is all I need because I'm an expert marksman...etc

200. This guy is an idiot

It's one thing to carry a pistol for self defense, but this is just frightening people for no good reason
