Introducing Discussionist: A new forum by the creators of DU

New Medical Exise Tax is being erroneously charged to consumers.

Check your receipts when you buy anything. A new Medical Exise Tax went into effect on the January 1 for manufacturers and importers of medical devices; however some retailer's cash register software has been adding the tax to all of its charges.

A coworker saw this tax on a receipt of hers from January 1, 2013 from a Cabelas in the North Texas area. After a little research we found this in Snopes:

http://www.snopes.com/politics/taxes/medicaldevice.asp

I called the store's customer service 800 number and they confirmed the error and offered to refund the money.

Be informed: The medical device tax is NOT a tax imposed on consumers, nor to be charged to consumers at retail level. Per the law, the tax applies solely to MANUFACTURERS AND IMPORTERS of medical devices. For reference, see http://www.irs.gov/uac/Medical-Device-Excise-Tax:-Frequently-Asked-Questions.

I'm wondering why I bother to post here, much less continue reading.

2. Twitchy.com is a right-wing website run by Michelle Malkin.

The story you quote from it is most likely complete bullshit. Try another source for your posts. That would be my recommendation.

3. Snopes says it's true.

It's an interesting article. Even right wing sites tell the truth now and then.

16. We all know never to have anything to do with Right Wing sites.

I would never want to have anything to do with Right Wing sites. Thanks for your input. As an expert on Right Wing sites, which most of us here are not, I will take your word for it.

17. Don't worry about it. Most most DUers don't have much knowledge of Right Wing

sites. The person to which you responded however, is quite an expert on Right Wing Sites.

In fact it is to your credit that you are not an expert on such sites.

6. Wait a minute

This crap has been showing up on Facebook like viral over the weekend, usually with some inane comments about look, I told you so! Obama's a-comin' for our guns! since the sales slip in question shows a gun purchase.

Cabala's is a sporting goods store, neither manufactures, imports nor sells any medical devises and was completely errant in collecting such a "tax". Which they refunded.

Facebook "friends" are typically real disappointed when this is pointed out.

10. This is not a gun post....

Its about non-medical devices being taxed incorrectly and about software glitches or user error implementing the software. This did happen to a co-worker.

But I've seen more than a couple of peeps on Facebook try and make it a gun rights issue.

9. No she isn't a liar, nor am I, nor am I a troll...

I called Cabellas 800 number myself to help her get to the bottom of this. Our first reaction was that they were trying to pass off Obama care on customers. I'm sure you won't believe me so call Cabellas yourself and tell them you purchased items on the 1st and ask them about it yourself. 1-800-237-4444. Have a nice day!

11. Internet search "medical excise tax"

and see what you find, then come back here and call me a liar. I don't get much beyond DU as far a forums go and I'm not going to apologize for referencing some site that says the same thing as several other sites. If you think I should know better, then perhaps you should know better to accuse some of something before you do your research. Now I know why I mostly just observe here. Forget trying to share relevant information. I found this information extremely interesting since, as someone who loves to fish, my husband and I spend lots of money at Cabelas. I called them myself because I wanted to know what the hell was up with this charge. Clearly, nothing Cabelas sells would be considered a "medical device."

Just trying to a good deed here. I thought I found something that might be of interest, at least it was to me. Clearly, I've just found a bunch of folks who assume the worst before they check something out. Ya'll sure know how to make an impression. Maybe I should put less stock in what I read on this forum.

22. I got the impression that is built into the tax software...

that is used to run the cash register computers. Like a setting that needed to be turned off in most cases; because I can't think of one thing cabelas would sell that would be considered a medical device. It is a legitimate federal tax, so if someone uses a program that is universally sold to different kinds of retailers, it may need to be tweeked accordingly. C's customer service told me that they it happened on 1/1 and they had corrected it by noon that day. I bet they raked in some extra bucks that day. If a shopper didn't notice the charge (I would be that shopper) I assume the retailer could just keep it.
