Leave it to a congressman from the ex-Confederacy, where the white rape of black women has a long and sordid history, tohold up the Violence Against Women Act in order to protect white men from prosecution by tribal courts if they rape a Native American woman.

Yes that’s right. Eric Cantor is the holding up VAWA for that reason.
Republicans have been fighting it tooth and nail because the new act would expand protections to immigrants, the LGBT community, and Native Americans. They are caving on the first two. But about Native Americans, Cantor refuses to budge. Here’s the low-down.

Leahy explained the provision, probably the least understood of the three additions in the Senate bill: It gives tribal courts limited jurisdiction to oversee domestic violence offenses committed against Native American women by non-Native American men on tribal lands. Currently, federal and state law enforcement have jurisdiction over domestic violence on tribal lands, but in many cases, they are hours away and lack the resources to respond to those cases. Tribal courts, meanwhile, are on site and familiar with tribal laws, but lack the jurisdiction to address domestic violence on tribal lands when it is carried out by a non-Native American individual.

That means non-Native American men who abuse Native American women on tribal lands are essentially “immune from the law, and they know it,” Leahy said.

The standoff over including VAWA protections for Native American women comes at a time of appallingly high levels of violence on tribal lands. One in three Native American women have been raped or experienced attempted rape, the New York Times reported in March, and the rate of sexual assault on Native American women is more than twice the national average. President Barack Obama has called violence on tribal lands “an affront to our shared humanity.”

Of the Native American women who are raped, 86 percent of them are raped by non-Native men, according to an Amnesty International report. That statistic is precisely what the Senate’s tribal provision targets.

For all intents and purposes, Eric Cantor is coming out as the defender of (mostly) whites raping non-white women. I’d say this is especially reprehensible. But it’s Cantor so it’s par for the course.

Again, the coming Republican coalition is just around the corner……

The text says that Leahy stated: "Currently, federal and state law enforcement have jurisdiction over domestic violence on tribal lands."

Generally speaking only the feds have jurisdiction over crimes committed by a non-Indian against an Indian, or by an Indian against a non-Indian when the crime occurs on tribal land. There is one large exception for what is known as Public Law 280 states, but the general rule is that there is federal jurisdiction only. The rest of his statement appears to be correct.

Tribal Courts also lack jurisdiction to enforce their subpoenas on non-Indians, or to charge non-Indians with perjury or criminal Contempt of Court.

After reading about Cantor I couldn't help but to see how Conservative Native Americans felt about this.So I found this website ..WWW.conservativeair.com.This is a website belonging to Conservative Native Americans.Their site is up to date and I did not see one mention of this issue.Very weird to say the least.

20. I work in a Domestic Violence/Sexual Assault program for a tribe in NW state.

Several years ago a man was caught anally raping a Native American woman by TWO tribal police officers. The feds never took on the case. The perpetrator was white. This native sister who never received justice from this violent act committed against her spirit and body will probably die from substance abuse. Please call Eric Cantor's DC office @ 202-225-2815 and urge him to pass the bill with Tribal Provisions, and call your state representative.

For some 6 months now, all we have heard out of those misogynosadists (yes, I made up that word) is rape, rape, rape, rape, rape. And now this. He's against the Violence Against Women Act. I don't know, nor do I want to know, his justification/rationalization for doing this. Whatever it is, it is insane thinking.

I would be willing to bet that incidences of rape have iincreased in the last 6 months since they started this whole rape campaign up. I thought it would end after the election.

40. I've read horror stories

 

where white dudes look upon entering the Reservation to rape a Native American woman as sport. It's just all good American Bubba fun on a Friday night.

No one seems to have jurisdiction. The white dudes don't live on the Reservation and the Native American courts have no rights over those not living there.

Maybe Eric will find out how this feels someday.



ETA: One would think that as a person of the Jewish faith, he would have some idea of oppression and how it feels. I just can't fathom how this man looks into a mirror.
