NBC Tells Obama Campaign Not To Use Its News Footage In Ads (Andrea Mitchell in the most recent)

NBC has asked President Barack Obama’s campaign to stop using the network’s footage in a recently released re-election ad, POLITICO has learned.

In a letter sent Friday night to Obama campaign manager Jim Messina, NBC told the Obama campaign to cease using network footage in a new 30-second spot, released shortly after Wednesday’s debate, in which Andrea Mitchell is shown on air citing an independent study stating that Mitt Romney’s tax plan would cost $4.8 trillion over 10 years, a source said.

NBC News has faced issues like this throughout the campaign, including a Romney campaign ad that featured Tom Brokaw.

“NBC News has not granted any campaign permission to use our news material. As is our practice, we have requested that the Obama campaign refrain from using NBC News material in this and future advertisements,” the network said in a statement.

2. Andrea Greenspan doesn't like it one bit.

 

She reported it and now NBC has a problem with it? She was reporting the news...independently???.....at least most people thought so.

I find it highly peculiar that a complaint comes up now....just one her segement....esepcially after she coddles John Sununu.

Obama should tell NBC to kiss his ENTIRE ass....

In Michigan, we keep seeing a Romney ad using Scott Pelley. How come CBS hasn't told them to desist? Perhaps they are a tad biased?

Seriously, I get why musicians get mad when their music is used. And if the Obama campaign were completely twisting around the news of the "newspeople" (Ha. I can't use journalist. It would be a lie.), I'd get it. But they don't want him to use NEWS in his ads?

That's pathetic.

The campaign is only using a short clip of the copyrighted material .... This is a clear Fair use issue ....

...How would NBC feel about the Obama Campaign pulling all of their ad money from NBC and spending it on other networks?

19. Given that campaign ads, from the candidates

get the lowest ad rate the network has, they'd probably be quite happy with both campaigns not advertising on their network. If I were having to sell prime time ads at the 2 am ad price, I'd be happy to stop doing so.

7. This would strike me as fair use

and that NBC can go fuck itself.

First, it's just a clip, and second, what is newsworthy is everything they used.

Probably best to play nice with them, but I'd be interested in a lawyer's take who knows more about this than I do.

8. The cannot stop them. It's called "Fair Use"

and documentary filmmakers use news footage all the time.

Not sure of exactly how it works with a campaign but the surrogates and Pacs can do it.. I think

9. NBC has a point and really the campaign should cite the study, not the talking head who read it.

To clarify (on edit) if NBC itself had done the study then fuck 'em. But they're just reading a study someone else did then quoting them quoting another source could be misleading.

NBC still uses the public airways if they want to take Obama's team to court lets go at it, it will only give the ad more air play. NBC had no problem using rev. wright's videos so turn around is fair-play.

17. Could be simple posturing to appear fair

They want to appear as middle as possible, hence a friendly letter which will never be enforced, but could be used to show lack of bias. I would take off the tin foil hats.

20. Thank you Internet! NBC can't keep people from seeing the commercial.

It's out there now. One unintended consequence is that NBC is spotlighting the ad. People who have never heard about it (like me) will be looking for it.
