Family barricades their home against eviction: Bank of America! Daily additions: BofA horror stories

Back in March, Dirma Rodriguez called Occupy Fights Foreclosures in Los Angeles in a panic. She and her family were being kicked out of her home onto the street after several now-obviously illegal moves by Bank of America and associated "home flipper" companies. OFF arrived to indeed find her, her family, and her property on the sidewalk and street outside HER home. OFF managed to get her back in, and after much bad publicity for Bank of America including a page 2 LA Times story, Dirma and her 27 year-old severely disabled daughter won back their home through the revelation of fraud in the foreclosure proceedings.

Surprise! Bank of America are still at it across the nation, this time most locally in the San Fernando valley of Los Angeles, seeking to evict a family after four years of run-arounds and non-response.

The bank raised the family's payments after the housing bubble burst, then when the Hernandez's asked for a modification, Bank of America told them if they missed their payments, their loan could be modified. On their third attempt at gaining a loan modification, their home was sold out from under them. (From the intro to the video seen below, just above the post "The top 1% is buying up all the real estate.”)

The Hernandez family have blockaded the entrance of their home after 19 days ago receiving an eviction notice and with the help of various Occupy groups (Occupy Fights Foreclosures, Occupy San Fernando Valley, Occupy the Hood, Occupy Skid Row, Occupy LA and more) have held off eviction, build community with neighbors, and gained growing recognition of the issue and of ways to fight back.

Yesterday, Bank of America crawled momentarily out from under their slimy rock because of the media attention Fort Hernandez are receiving, and phoned them. When you listen to this, you will note several "outs" they've left themselves to tut-tut over and just continue the foreclosure proceeding. Considering robosigning and many proven cases of outright fraud coming from the banks, it's just how they work, until you are too tired or confused to fight them any more. BANG, they get your home. If English isn't your native language, you're even more vulnerable to being screwed.

Also note that =they will not answer= the question of whether BofA actually still own the title to the home and thus have any right to engage in a modification.

BofA launches 2nd round of bulk foreclosure sales

For the second time in five months, Bank of America is tapping the red-hot market for foreclosed homes by seeking bids on a bulk offering of several hundred single-family homes.

Over the past several weeks, the nation’s second-largest bank by assets has solicited bids for a bulk deal that includes up to 500 largely vacant single-family homes, some of which BofA acquired after its merger with Countrywide Financial, according to several sources within the real estate and mortgage sectors. Countrywide was one of the largest subprime lenders in the United States.

The bulk deal, which includes foreclosed homes in California, Florida, Arizona, Texas, Pennsylvania and Georgia, is one of the biggest block offerings of foreclosed homes ever done by a bank, these sources say.

We were successful on both fronts. That same day, BofA called Rev. Vanzant in the hospital to set up a call to discuss solutions. Once that discussion began, though, it became clear that they hadn't quite heard us. Rev Vanzant was offered more money to move out of his home in a gentrifying area of NE DC. Banks' Disorganization Pushed 800,000 Homeowners Into Unnecessary Foreclosure: ProPublica

The report does not identify these poor performing banks, but it's not hard to ID them. A "few large servicers [have offered] modifications at half the rate of others," the authors say. The largest mortgage servicers are Bank of America, JPMorgan Chase, Wells Fargo and Citi.

Bank of America in particular (the largest of all the servicers when HAMP launched) has been far slower to modify loans than even the other large servicers, as other analyses we've cited have shown.

Earlier this year the nation's largest banks reached a $25 billion settlement with the U.S. Department of Justice and attorneys general from 49 states, including Georgia. The banks include Wells Fargo, Bank of America, GMAC/Ally Bank, Citibank and Chase.

Despite the settlement and promises to stop, it appears banks are still filing fraudulent assignments. O'Brien showed one assignment he received this spring that was completed by a suspected robosigner.

"I really believe [the banks are] a criminal enterprise. I truly believe this. They know what they're doing. They sit there and say they're too big to fail but they're not too big to go to jail," O'Brien said.

Van Nuys, CA, 09/18/2012 — (VIDEO) Early this morning at approximately 12:04am, two LAPD officers and two Department of Children & Family Services agents arrived at the Hernandez home on an unannounced visit. Children’s Social Worker Albert “Jack” Johnson, of the Emergency Response Command Post, claimed that they had received a tip from an undisclosed source alleging that there was no running water or electricity at 14620 Leadwell St. They questioned the family outside the home who stated that the claim was unfounded. The family denied their request to enter the home. The family also denied their request to see the child at 12:04am on a school night. The child had been asleep since 8pm.

There have been multiple visits by the LAPD to the home recently for unsubstantiated complaints from unknown sources. Is this a pattern of intimidation by Bank of America using law enforcement?

Bank of America denies employee loan modification horror story


2010:

Bank of America is defending itself after a former employee criticized the company’s call center policies. The woman said, when she worked in the call center, bank policy allowed her only three attempts to notify loan modification applicants of key paperwork they needed to take care of.

The woman said she worked at the Bank of America call center in Tempe in December, calling homeowners to schedule notary service and finish up modification paperwork. But she says she quit in disgust over policies. “You get three attempts and that is it– whether your phone’s busy, left a message, no answer. That’s three attempts,” she said. “After three attempts the file gets closed.”

"I worked as a temp for Bof A in Glendale, CA. I tried to help homeowners who wanted to do a short sale. I was fired because I had a heart. The bank would loose (sic) documents not once, not twice but 20 times over deliberately giving wrong fax numbers. Employees were not trained properly, managers refused to really provided help."

"B of A doesn’t want to modify loans !!!!! They make out much better by foreclosing or doing short sales instead because the government covers their losses.

My wife died a year ago in August in the midst of trying to modify her mortgage...Now it is more than one year later and they are still sending my wife letters and calling the house asking to speak to her about her loan ! Even more disrespectful is the fact that I faxed her death certificate to B of A almost 11 months ago and they actually lost that too !! I have the name and employee ID and fax number at B of A where this and 20 other pages of documentation were sent and no one knows who this person even is ! How do you lose a death certificate ???"

Bank of America reportedly plans to cut 16,000 jobs

By the end of the year, Bank of America Corp. hopes to get rid of 16,000 jobs, close 200 branches and shrink its mortgage operation, according to a document sent to top management.

The institution is accelerating its cost-cutting strategy, planning to pare its operations so much that it will lose its spot as the nation's largest bank employer. The company will fall behind the likes of JPMorgan Chase & Co., Wells Fargo & Co. and Citigroup Inc.

The proposed cuts would bring Bank of America's workforce down to 260,000 by year-end, according to the document, which was summarized for the Wall Street Journal.

I lend you money so you can buy a house and I collect payments from you, with interest.

Our arrangement is that your payments will go up, big time, at some point, but I tell you not to worry, because I will let you refinance before that happens.

I keep insurance on the loan, so if anything happens, I get mine.

When your payments are about to increase, I don't let you refinance. After all, the housing bubble has burst, and the over-inflated value we agreed with you that the home was worth is less than half of that, so you're underwater, and we can't lend to someone underwater, now, can we? You manage to meet the new payments as long as you can, because it is your house, after all.

When it becomes clear you aren't going to be able to keep up the new, huge payments, I sell your loan to another bank or investment company or individual, whatever, as long as they're overseas, as a good investment. I get my buddies in the industry who rate investments to say they're super-good.

Then, I watch as you go under, the investor overseas is left holding the bad debt and I collect the insurance on the defaulting loan.

Ta-Daaa... (The Hernandez family were told to stop paying their mortgage in order to qualify for a loan adjustment...and the bank stole the home.)

She says she tried negotiating a lower payment with Wells Fargo when she saw her layoff coming. She submitted supporting paperwork. Wells Fargo misplaced it. So she tried again.

“They said re-submit the papers again, and I keep re-submitting the papers, and instead of saying I guess, they keep saying we didn’t get the papers, we didn’t get all your information, so I started to get the run-around,” she said.

And Wells Fargo told her city sheriff’s deputies would be showing up Friday to pile her belongings on the street and padlock her house.

My husband owned his own business. He had a massive heart attack. We are in our sixties and lost all our saving to medical. I call BAC for a loan modification. That was Dec '09. Ten faxes later and 3 Fed Ex with all paper work they requested, as of today 3/38/11 they are going to foreclose, they said because I never sent requested paper work.. I can't believe this. America is great. We worked all our lives and we are going to be in the street.

Nanette, I am truly disgusted by Bank of America's behavior. Your story is repeated several thousand times over. If I were you, I would sue Bank of America. If you can't find an attorney, sue them yourself.

"Why? Because another unit of Bank of America erroneously reported to credit agencies that the family was seeking a loan modification, ruining their credit rating and as the result (sic) putting their mortgage into default."

As I observed in my earlier article, about Bank of America allegedly cutting a credit score over a mortgage note inquiry: "A single case—no matter how compelling or potentially illustrative of a broader point—isn't yet a trend."

In 2008 Banks and mortgage rating firms illegally sold mortgages at high ratings and at the same time purchased insurance in speculation against these mortgages so that when they were not paid off at the inflated interest rates by borrowers, banks received double compensation (Inside Job). Last year in California, 1.2 million homes were foreclosed, and another million are expected to be foreclosed in 2012. We MUST hold the banks accountable for the social crimes they are committing! Fort Hernandez are the front page story on the LA Weekly!

Now a preliminary analysis reveals the largest escalation of foreclosures came from Bank of America (BAC). Just in California, default notices sent by Bank of America soared 96% in August from the previous month.

The dramatic rise is particularly evident in certain California towns and cities. For instance, notices surged 95% in Fresno and 76% in Sacramento.

As of August 2012, one in every 681 American homes is in foreclosure, according to RealtyTrac. Statistics show about 4 million families lost homes to foreclosure since the start of the crisis in December 2007, and millions more are in danger. According to RealtyTrac, there are hundreds of homes in the Hernandez's ZIP code in the foreclosure process.

The housing crisis and ensuing economic fallout rolled back hard-won progress for Latino and black communities, draining untold wealth from neighborhoods. Van Nuys is roughly 60 percent Latino, according to a 2009 Los Angeles Times survey. A 2010 study by the Center for Responsible Lending showed black and Latino families were specifically vulnerable to predatory loans. They were a whopping 70 percent more likely to suffer foreclosure than whites.

"All their wealth was in their homes," said Occupier Esho Funi. "There's no wealth left in those neighborhoods, and these families are less likely to fight back."

In the meantime, the federal government used $700 billion in public funds to rescue banks who'd given out the failing home loans.

Bank of America has reached what is being called the largest settlement for a financial-crisis shareholder class-action lawsuit.

Today’s $2.43 billion payment to shareholders that alleged the bank had hidden losses at Merrill Lynch from bank shareholders voting on the acquisition, which closed the first day of 2009. The bank continues to deny the allegations.

The pact becomes the latest in a rather long list of settlements the bank has reached over various mortgage, securities actions and customer lawsuits since 2009. Not all of the money has been in direct penalties and damages, some is aid the bank agrees to give to borrowers.

Shumate May 22, 2010 in St. George, Utah has stopped all foreclosure proceedings in the State of Utah by Bank of America Corporation; Recontrust Company, N.A; Home Loans Serving, LP; Bank of America, FSB;www.envisionlawfirm.com. The Court Order if allowed to become permanent will force Bank of America and other mortgage companies with home loans in Utah to adhere to the Utah laws requiring lenders to register in the state and have offices where home owners can negotiate face-to-face with their lenders as the state lawmakers intended (Utah Code ‘ 57-1-21(1)(a)(i).). Telephone calls by KCSG News for comment to the law office of Bank of America counsel Sean D. Muntz and Amir Shlesinger, Esq. of Reed Smith, LLP, Los Angeles, CA and Richard Ensor, Esq. of Vantus Law Group, Salt Lake City, UT were not returned.

The lawsuit filed by John Christian Barlow, a former Weber State University student who graduated from Loyola University of Chicago and receive his law degree from one of the most distinguished private a law colleges in the nation, Willamette University founded in 1883 at Salem, Oregon has drawn the ire of the high brow Bank of America attorney and lawyers of the law firm of Reed Smith, LLP, the 15th largest law firm in the world, according to their website.

Barlow said Bank of America claims because it’s a national chartered institution, state laws are trumped, or not applicable to the bank. That was before the case was brought before Judge Shumate who read the petition, supporting case history and the state statute asking for an injunctive relief hearing filed by Barlow. The judge felt so strongly about the case before him, he issued the preliminary injunction order without a hearing halting the foreclosure process. The attorneys for Bank of America promptly filed to move the case to federal court to avoid having to deal with the judge who is not unaccustomed to high profile cases and has a history of watching out for the “little people” and citizen’s rights.

My understanding is that the Hernandez family were tricked into stopping their payments in order to qualify for a loan modification after the housing bubble burst, sending their payments up.

LAPD have made arrests of those entering/leaving the area and in one case, for recording them (which is perfectly legal and in one ruling, the basis for lawsuit). "Inspectors" have been nosing around, taking photos because the bank has just said they will not give a modification and intend to evict.

Police and sheriffs are the bank's private army. Note that they do not evict and arrest those engaging in the fraudulent foreclosure machine!

by the socialist revolution that considers home a basic human right. The home ownership was not to be used as market commodity, but as said, human right. Latest I hear is that now they are thinking about allowing homes to be sold on market, which looking at situation in America, does not sound like the smartest move.

I'll keep telling on them until they are put out of business.

BofA stole $25K from a disabled young man who had been saving for many years. Because of his son's disabilities, the dad remained as co-signer after the son reached the age of majority.

When the parents hit a rough patch during the economic downturn they had to deal with a foreclosure. BofA took the foreclosed home AND the contents of the son's savings account. Because they could.

Bank of America has no problem stealing from people with disabilities. Keep it in mind.

Fort Hernandez has been under popo surveillance all day...they have been posted on the corner watching the house. One of our folks who have just left was pulled over...we have people go to where they have the sister pulled over. Please spread wide.

Sister Dara is, right now being harassed by 10 police officers around the corner by Lucky's, after being pulled over for a routine traffic stop. It's sad that those sworn to protect and serve the people are so eager to oppress them. We should be able to expect more from those who we pay to protect us. Yet another sad and embarrassing day for the LAPD and those they are supposed to serve.

The reason they are becoming bolder again is because of the collapse of the two cases, one in Nevada, I believe, which gave us hope that finally some of these criminals would pay for their crimes.

Not sure if you remember, but when the deal was made with the States Attorneys and the NY US Attorney finally signed on, people wanted to be sure that this agreement would NOT protect them from prosecution and would not interfere with the two cases already filed for Foreclosure Fraud. We were assured this was the case, and people looked away.

We should know better. You have to watch them like the roaches they are because they never, ever give up.

The main witness in the most important case which we hoped would be the example for all the others to follow, committed suicide. She was the Prosecutions main case.

I had not followed that story, assuming we would hear about it when it finally went to court. Instead, I just found out that both cases are now gone. Once again the bad guys win.

And now they feel emboldened. They are untouchable. Until we the people finally have had enough.

Absolutely. The combined voice of the people, saying NO! is what it takes. If any reading wish to help, please post this story on your facebook or twitter or reddit, etc. Please spread the message far and wide. They have us divided; we CAN unite in saying NO! to the horrible, family-destroying problems we face in this country. We've already done so to ALEC and Rush Limbaugh (WHO? HAHAHA). We can do it again. Spreading the story agitates. Contacting the bank and the media about this lets them know WE will not take it anymore. That's what solidarity is; saying YES together to what we know is good for us, and saying NO together to what harms us and must be changed. You don't have to march in the street. Posting this to Los Angeles media facebook pages is a great start. Posting it to BofA pages is even better.

The more attention and pressure they feel, the more chance they will scurry back under their poisonous rock and leave our homes to their owners! Occupy Fights Foreclosures just beat the banks again yesterday, saving a family's home out in Anaheim (where over 700 homes are targeted by banks). Story in the Activism->Occupy Underground forum.

Thank so much sabrina 1. This =is= about people. Just because we many not have been hit personally does not mean it cannot happen as this illegal foreclosure engine rolls along uncontested. Thankfully, contesting it is as easy as adding your voice to this thread, just a K&R, so Bank of America will see it. And keep seeing it. Thank you all.

Dang, extremely little Fort Hernandez content, and it excludes the fact that BofA tricked them into taking a loan modification by stopping payments...then selling the home in foreclosure during that time!
