Trump wanting to have the day off for Barron’s graduation gave the DA an extra day they used wisely, digging up video footage of Trump w/his bodyguard Schiller at almost the exact time Cohen said he called Schiller to speak to Trump. It will be the 1st thing played after lunch.






That Oct. 24, 2016, Phone Call Comes Up Again
Prosecutors have an image, taken from C-SPAN's archives, that show Trump and his bodyguard Keith Schiller together on Oct. 24, 2016, at about the time that Cohen said he called to get authorization to pay off Stormy Daniels.

Showing they were together would refute Trump’s lawyers’ suggestion that maybe Trump wasn’t with Schiller, highlighting that it's possible Schiller may have been able to pass the phone to Trump when Cohen called.

In Trump Trial Photo with Schiller on CSPAN Raised After Cohen Cops to Keeping 30K

100 CENTRE ST COURT, May 20 – In the Trump Trial what was supposed to be the last morning of the prosecution case ended with a fight whether C-SPAN footage of Trump with his bodyguard Keith Schiller on the evening of October 24, 2016 was relevant and if so, it is is hearsay.

Justice Merchan rules that it's relevant, and said he would return from the hastily called lunch break with his views on hearsay and its exception. Would the prosecution have to arrange to fly back in their C-SPAN witness from Ohio?

Already, closing argument were pushed a full week back, from May 21 to May 28, after Memorial Day. Would Justice Merchan maintain his Wednesday breaks, inserting an off day between summations and deliberations?

Near the end of cross examination of Cohen, Trump's lawyer Todd Blanche got Cohen to admit stealing $30,000 due to Red Finch (for buying IP addresses to juice Trump up to ninth place in a CNBC poll).

But then, in the style of Earl Stanley Gardner's Perry Mason, the photo Googled from CSPAN's website.

UPDATE: The C-Span exhibit WILL come in after all, after prosecutors and defense attorneys agree to a stipulation that will avoid the issues of recalling the other witness.




Court is back in session. Judge Merchan takes the bench and rules that the photos that the prosecution wanted to use (Keith Schiller and Trump) are hearsay and cannot be admitted with a proper foundation.

Blanche tells the Court that the Defense will likely rest today but there remains the chance that they might put on a witness today.


The prosecution is asking for leave of court to be able to bring the C-Span witness back to authenticate the photos so that they can be entered into evidence.

Blanche objects, saying: “That’s not the way a trial is supposed to work, judge”

Merchan suggests adjourning until tomorrow morning so that the Prosecution can bring the C-Span Records Custodian back.

MANGOLD: CSPAN will make him available tomorrow at 9:30 am.

BLANCHE: this will be the fifth or sixth time they’ve run out of witnesses and we have witnesses ready to go

STEINGLASS: “[The Defense] is just wrong.” This witness is so narrow, none of the defense witnesses speak to it and we can go on or Mr. Blanche can put his case on tomorrow
The ball is in Mr. Blanche’s court

MERCHAN: Look, if time were of the essence, I would agree with you Mr. Blanche. We are essentially off for a week, there is no prejudice, you can present your case out of order or the witness takes the stand at 9:30 and then you rest. Nothing has changed.”
