Attempted murder has always been separate and apart from actual murder, with different consequences.

Even though the same bullet, fired in the same way, could end in either outcome but for the skill and availability of the responders. Your intent was the same. Society puts a different weight on the penalty based on the outcome.

But society did build in mitigating gates to these rules. You aren't charged with murder if you kill somebody while driving drunk because that wasn't your intent. That's why the charge is manslaughter, a lesser charge. And there are several levels of manslaughter.

So your rights aren't being trampled. Societies rights are being protected. You need to realize that if commit a crime and somebody dies, you will pay for that death.
