Donald Trumps criminal trial resumed this morning with his defense attorneys continuing to cross examine Stormy Daniels. They went hard at her, but he stood her ground and remained highly credible. Daniels ended up doing a lot of damage to Trump, both in terms of the trial and in terms of political reputation. So it perhaps wasnt surspiring that as soon as she was off the stand, Trumps defense attorneys hit the panic button about another witness in this trial.
Trumps attorneys have now moved to exclude Karen McDougal from testifying at all. This is a silly move. It has zero chance of working. It wont help Trump on appeal. And the move merely tells the general public that Trump is very much afraid of what McDougal is going to say about him, which will only serve to put more public attention on her upcoming testimony.
Trumps attorneys are now also demanding that Trump be exempted from his gag order with regard to Stormy Daniels, so he can publicly fire back at her over her testimony. This also has no chance of being granted.

Trump won't be able to attack her, which leaves him with nothing.
The affair lasted about 10 months.

That kind of denial is a lot harder to pull off when you were in a 9-10 month relationship with "that woman," and friends and associates probably saw you two together on numerous occasions!

As Rick Scott showed up to blather about the very unfair trial this morning. I assume it will be a different political well known for committing fraud every morning as long as the trial continues. No one quite blathers like Trump, though.

But McDougal will solidify Stormys testimony as there are bound to be similarities.
Cohen will give the defense what they need to tie the case up with a bow.
The defenses only hope is a mistrial or an Act of God.

And then they could get him for perjury. This is why a lot of those court cases fell apart over the stolen election in 2020. TSFs attorneys knew they would eventually have to perjure themselves because they knew Trumps claims were total bullshit.

(3,793 posts)As I'm sure the Judge either did or will point out when he overrules this ridiculous motion. His attorneys had every opportunity to cross-examine her, therefore there's no NEED to "fire back" at her in the court of public opinion. Anything he says could be considered a violation of the gag order at best, and slanderous and borderline witness intimidation against future witnesses at worst. Granting such a motion would be like handing Trump a pass to violate several different laws. No Judge in America would do that (well, almost none--but I'm sure this one won't).
This motion is so ridiculous that I think Trump's attorneys are treading very close to the line separating zealous representation from frivolous proceedings (aka contempt). I really think the Judge might consider holding them in contempt for filing all these sham motions. He's already made a ruling that they were not to file any more motions without prior permission of the court.

(5,049 posts)Its not quite the same. Her testimony could provide additional sordid details on their affair, which would humiliate him and potentially hurt him politically. But I have to assume that the prosecution knows what its doing.

(17,128 posts)I suspect Judge Merchan will allow Karen McDougal to testify because she too was part of the hush money scheme to keep quiet, the catch and kill scheme David Pecker testified to, and her relationship that lasted months with TSF. It is all related to the falsifying of business records that influenced the election in 2016.
TSF can shit his pants all he wants. He is in the Criminal defendant's chair and he has no power or sway with the Judge.
